Neck Injury Settlements

A neck injury can cause a great deal of pain and have a significant impact on your everyday life, and as such, compensation settlements need to reflect this. This guide looks at the various levels of severity of neck injury claims and gives an indication of the compensation amounts that may be awarded for each type of neck injury claim.

These amounts are taken from the JSB Guidelines used by courts to determine how much should be awarded for certain kinds of personal injuries. However, these amounts reflect awards for pain and suffering, not for any financial loss.

How Much Compensation for a Neck Injury Claim?

The deciding factor isn’t usually down to how your accident happened, be it a car accident, accident at work, or an accident in a public place. The neck injury compensation you could be awarded will depend on the severity of injury, intensity of pain, consistency of symptoms, impact on life, impact on your ability to work, and any medication taken.

Minor Neck Injury Settlements

Very minor claims, where you make a full recovery in 3 months or less, will attract an award of around a few hundred pounds up to £1,860. Where a full recovery is made in 3 months to one year, the award should be around £1,860—£3,300.

If your recovery takes longer, from one year up to two years you may be awarded significantly more with the guidelines indicating a compensation for neck injury amount of between £3,300—£6,000.

Neck Injury Settlements for Moderate Injuries

If you suffer a moderate injury, which may have exacerbated a pre-existing condition, usually over less than 5 years, you can expect to receive a compensation payment of  £6,000—£10,450. Moderate injuries, for example:

  • Soft tissue injuries
  • Wrenching type injuries
  • Disc lesion
  • Injuries resulting in cervical spondylosis,
  • Injuries causing serious limitation of movement,
  • Permanent or recurring pain, stiffness, or discomfort
  • Injuries with possible need for further surgery

In these circumstances, your neck injury settlement amounts and compensation payment should be around £10,450—£19,000.

Compensation for Serious Neck Injuries

Chronic conditions, typically involving referred symptoms to other parts of the body, or serious soft tissues injuries to neck and back combined will attract neck injury settlements and awards of £19,000—£29,250.

Severe types of neck injuries including; fractures or dislocations or severe damage to soft tissues and/or rupture tendons that lead to chronic conditions and significant permanent disability. These will attract awards of £34,575—£42,550. Where serious damage or fracture to the spine is experienced by the sufferer awards of  £50,000—£99,500 can be expected.

The most serious types of neck injuries where the sufferer experiences incomplete paraplegia, has little or no neck movement wearing a collar for years, and severe headaches see awards in the region of £112,750.
